1. Introduction

EnlivenHealth, Inc. provides messaging services to pharmacies to support patient communications, including prescription notifications, appointment reminders, and other healthcare-related communications. Additionally, EnlivenHealth sends messages to pharmacy staff, such as training notifications or alerts about delivery delays occurring at the pharmacy. All references to EnlivenHealth, “we,” “our”, or “us” refer to EnlivenHealth, Inc. and Omnicell, Inc. (EnlivenHealth’s parent company)together.

This SMS Privacy Notice explains how EnlivenHealth collects, uses, and protects personal information in connection with SMS/text messaging services provided on behalf of pharmacies that use EnlivenHealth services (“Pharmacies”).This SMS Privacy Notice applies to your use of the SMS text messaging services. In addition to this SMS Privacy Notice, the EnlivenHealth Privacy Notice may govern the relationship between you and us in other contexts. In addition, please refer to your Pharmacy’s privacy policy, which may also apply to the information and communications shared with you by EnlivenHealth.

2. Role of EnlivenHealth

EnlivenHealth acts as a service provider / processor to Pharmacies. Pharmacies determine what information is collected and why. Pharmacies are also responsible for gathering your consent to receive SMS messaging, unless the Pharmacy has engaged EnlivenHealth by an agreement to gather that consent on the Pharmacy’s behalf. EnlivenHealth processes your information on behalf of the Pharmacies in line with its agreements with the Pharmacies and applicable law. You should refer to your Pharmacy’s privacy notice for additional details.

3. Information We Collect

EnlivenHealth may collect or receive the following information from you directly or from your Pharmacy:

Contact Information: mobile phone number, name.

Messaging Data: message content, delivery status, opt-in and opt-out preferences.

Pharmacy-Related Information: messages may relate to pharmacy services such as prescriptions and their status, training information for staff, and delays in pharmacy deliveries.

Technical Information: time, date, metadata, carrier, and routing information.

The information we collect from you or receive about you is referred to collectively in this SMS Privacy Notice as “Your SMS Information.”

4. How We Use Your Information

EnlivenHealth uses Your SMS Information solely to send messages on behalf of Pharmacies, manage delivery, maintain consent records, ensure system performance, and comply with legal obligations. We will only use Your SMS Information for marketing or promotional purposes where you have given your prior written consent to receive marketing and promotional messages.

5. SMS Consent and Opt-Out

EnlivenHealth will only send text messages where you have agreed to receive text messages from your Pharmacy. Your Pharmacy may obtain your consent to receive text messages, or your Pharmacy may engage EnlivenHealth to gather your consent on the Pharmacy’s behalf. Text messages will include opt-out instructions, such as replying STOP. Opt-out requests will be honored promptly, and if you decide to opt-out, we may send one additional message to confirm that you have opted out.

6. Data Sharing and Disclosure

Information that you provide to your Pharmacy or EnlivenHealth may be shared between your Pharmacy and EnlivenHealth, Omnicell, Inc. (EnlivenHealth’s parent entity), and with service providers that support SMS messaging, such as platform providers and phone companies. Third-party service providers used to deliver SMS services are contractually required to protect Your SMS Information and comply with laws.

EnlivenHealth will not share Your SMS Information with third parties or affiliates for marketing or promotional purposes without your prior written consent. Text messaging originator opt-in data and consent will not be shared with third parties.

EnlivenHealth reserves the right to disclose any information, including Your SMS Information, as necessary to satisfy any legal obligation, governmental request, judicial or administrative order; for the prevention, detection, and investigation of cyber incidents; to protect the personal safety of our users or the public; and to protect our rights and our property.

7. Data Retention

Your SMS Information is retained only as necessary to provide services and comply with legal and contractual requirements.

8. Data Security

EnlivenHealth implements administrative, technical, and physical safeguards to protect Your SMS Information.

9. Your Rights

You may have a right to access, correct, or delete Your SMS Information; these requests should be directed to your Pharmacy. You may also have the right to opt out of communications. To opt out, follow the instructions in your message or in the EnlivenHealth SMS Terms of Service.

10. Changes to This SMS Privacy Notice

This SMS Privacy Notice may be updated from time to time with a revised effective date.
